THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18742 of 2017 ORDER:

Heard Mr.N.Hari Prasad for petitioner and Mr.Sarath holding for learned Additional Advocate General.

The petitioner aged 17 years represented by his father as next friend and guardian has filed the instant writ petition challenging proceedings No.E1/719/2017 dated 30.05.2017. Through the proceedings impugned in the writ petition, the 2nd respondent/District Collector ordered for shifting a few of the Educational Institutions to some other place or location and permitted for demolition of dilapidated and old structures. The petitioner in the instant writ petition is concerned with Government Junior College proposed to be transferred and established at District Intermediate Education Office, Karimnagar. The petitioner under apprehension that the College is going to be shifted to a far of place and that the College building is a heritage building and not to be demolished, has filed the present writ petition.

The 2nd respondent filed counter affidavit explaining the circumstances under which the proceedings impugned in the writ petition have been passed and the steps taken by the District administration either to continue to provide the same facilities to student and/or better facilities at the new location. With the explanation stated in the counter affidavit, Mr.Hari Prasad has confined his challenge to the other objection namely, the demolition of a heritage building. Mr.Sarath has placed before the Court, the photographs of the College and an old building constructed long ago. He clarifies basing on the instructions given by the officer present in the Court to assist him, the demolition ordered through proceedings dated 30.05.2017 is not the main building but tiled house which is located in the premises.

After this position is also explained, Mr.Hari Prasad informs the Court, the purpose of filing writ petition is over for the petitioner has completed II year Intermediate.

keeping in view the submissions made by Mr.Hari Prasad, the writ petition is dismissed by accepting the stand taken by the District Collector both in the counter affidavit and through the Special Government Pleader. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
