THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13509 OF 2018 O R D E R:

Petitioner has filed this Writ Petition alleging that the 1st respondent has not disposed of his representation dt.01.11.2017 opposing grant of permit to 2nd respondent.

Admittedly petitioner filed O.S.No.292 of 2017 on the file of the V Additional Junior Civil Judge, Kukatpally at Miyapur for perpetual injunction against the 2nd respondent and obtained status quo in I.A.No.443 of 2017 therein against the 2nd respondent.

When such a civil litigation is pending in a competent civil Court, the petitioner cannot compel the 1st respondent to resolve the issues of title or possession while considering the application for grant of permission to the 2nd respondent. 4.

Therefore, granting liberty to the petitioner to pursue the proceedings already initiated in the Civil Court referred to above, this Writ Petition is dismissed at the admission stage. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
