HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19242 of 2017 ORDER:

The petitioner apprehending demolition of construction or a portion of construction in the house property bearing H.No.2-144, Ravulapalem, East Godavari District, without recourse to law, has filed the instant writ petition.

2. Learned Assistant Government Pleader (Revenue), on written instructions dated 14.06.2017, submits that the Officers, if intend to proceed against the marked portion of petitioner's building for removing the encroachment, will follow the procedure stipulated by law, afford opportunity of hearing to petitioner and proceed as is warranted. The statement is placed on record.

3. The writ petition is, accordingly, disposed of. In view of the statement, it is needless to observe that the structures existing as on date ought not to be demolished, except by following the procedure referred to above. No order as to costs.
