This Criminal Petition is filed under Section 482 Cr.P.C. seeking to modify the order dated 26-112015 in Crl.R.P.No.61 of 2015 whereby and whereunder the interim custody of the Tata Indica Vista LX-TDI car bearing regd. No.AP-31-CH-8437 was ordered to be returned on execution of bond for Rs.10,00,000/- with one surety for a like sum to the satisfaction of II Additional Chief Metropolitan Magistrate, Visakhapatnam and on condition to produce the property as and when required by the Court.

Heard and perused the material available on record.

After arguing for sometime, the learned counsel for the petitioner confined his arguments only to the extent of modifying the quantum of execution of bond with one surety.

After perusal of the material on record and on hearing the learned counsel for the petitioner, the order dated 26-11-2015 in Crl.R.P.No.61 of 2015 is modified to the extent of the petitioner executing a bond for Rs.2,00,000/- (Rupees two lakhs only) instead of Rs.10,00,000/- with one surety for a like sum each to the satisfaction of II Additional Chief Metropolitan Magistrate, Visakhapatnam, for release of the crime vehicle.

The other conditions as imposed remain

unaltered.

With the above modification, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. ________________ RAJA ELANGO, J Date: 18-04-2016 Ksn
