HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.174 of 2016 ORDER:
This petition is filed to withdraw C.M.A No.2 of 2016 from the file of I Additional Chief Judge, City Civil Court, Secunderabad and transfer the same to any Additional Chief Jduge, City Civil Court, Hyderabad.
2. This court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due and file proof of service. In compliance of the said order, advocate for petitioner filed Memo on 29.03.2016 along with postal receipts and postal acknowledgements of R-1 to R-3 which disclosed that notices were duly served on R-1 to R-3. In spite of service of notice R-1 to R-3 neither appeared in person nor through any advocate.
3. Heard advocate for petitioner.
4. The main grievance of petitioners is that opposite party is proclaiming that Presiding Officer would do favour to them, therefore they apprehend that they may not get fair justice before I Additional chief Judge, City Civil Court, Secunderabad.
5. Considering the reasons stated in the affidavit, C.M.A No.2 of 2016 is withdrawn from the file of I Additional Chief Judge, City Civil Court, Secunderabad and transferred to III Additional Chief Judge, City Civil Court, Hyderabad for disposal in accordance with law.
6. Accordingly, this Transfer Civil Miscellaneous Petition
