ORDER

Challenging registration of Cr.No.491 of 2016 by the 2nd respondent on 3.12.2016 against the petitioner, the present writ petition is filed.

The said crime was registered pursuant to a reference made by the Judicial First Class Magistrate, Kurnool. Hence, it cannot be said that registration of crime is bad in law. A counter-affidavit is filed by respondents 1 and 2 stating that investigation is in progress and after completion of the same, appropriate report will be filed before the Court concerned. In the circumstances, this Court is not inclined to interfere with registration of crime. However, the 2nd respondent is directed to follow due process of law while investigating the crime including compliance of provisions under Section 41-A of the Code of Criminal Procedure.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
