HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.4446 of 2016 ORDER:

Heard both sides.

Leave about the certified copies granted by the Court are public documents and it is not even the issue herein that is public document or private document, but for if at all on relevancy and admissibility, the Court is competent to decide under Section 136 of the Evidence Act and the party who want to rely must show how relevant and admissible if sought by Court from that provision; the fact remains from the expression of the Apex Court in Bipin Shantilal Panchal Vs. State of Gujarat1 all objections other than stamp duty and registration can be decided ultimately while marking subject to objection regarding proof, relevancy and admissibility.

Having regard to the above and in the result, the revision is allowed to the extent of directing the trial Court to mark the documents subject to proof, relevancy and admissibility and all objections are left open ultimately to decide. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
