THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.37981 OF 2015 ORDER:

Though the Writ Petition is filed questioning the preliminary notification, dated 21.09.2015, the notification itself gives 60 days time for any person interested to file his objections. Accordingly, the petitioner has submitted his objections on 01.10.2015. Under the scheme of Central Act 30 of 2013, all objections are required to be considered before issuing the final notification. Therefore, I do not see any reason for apprehension of the petitioner for claiming dispossession, particularly his objections are yet to be considered and the stage for taking possession under Section 38 of the Right to Fair Compensation and Transperancy in Land Acquisition, Rehabilitation and Resettlement Act, 2013 will not arrive in the near future.

Respondents 3 and 4 shall consider the objections of the petitioner, in accordance with law, and take appropriate decision. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________________ VILAS V.
