THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No. 2352 of 2014 JUDGMENT:- The present Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. aggrieved by the order dated 31.10.2014 passed in Crl.A.No. 29 of 2014 on the file of the Sessions Judge, Mahila Court, Vijayawada, Krishna District. The facts in issue are as under:
The 1st respondent herein filed D.V.C.No.75 of 2012 on the file of I Additional Chief Metropolitan Magistrate, Vijayawada, claiming various reliefs under the Protection of Women from Domestic Violence Act, 2005. After a full-fledged trial, the trial Court by its order dated 26.02.2014 allowed the D.V.C. and ordered the petitioner to pay maintenance @ Rs.20,000/- per month to the 1st respondent on or before 2nd of every month besides Rs.5,000/- per month towards rent for her accommodation. The trial Court further ordered the petitioner to pay a sum of Rs.25,000/- to the 1st respondent towards compensation to meet the expenses incurred by her. Challenging the same, the petitioner filed Crl.A.No. 29 of 2014 on the file of the Sessions Judge, Mahila Court, Vijayawada, Krishna District. By its judgment dated 31.10.
2014, the appellate Court, while setting aside the order of the trial Court, remanded the matter back for fresh consideration and ordered the petitioner to pay maintenance @ Rs.10,000/- per month to the 1st respondent on or before 10th of every month from the date of petition till disposal of main D.V.C. before the trial Court. The appellate Court further directed the trial Court to dispose of the main D.V.C. within four months from the date of the said order. The same is questioned in this revision.
Heard both sides and perused the record.
When the matter is taken up for hearing, both the parties agreed for disposal of the revision on condition of the petitioner depositing 50% of entire arrears which got accrued from the date of petition till December, 2014 before the trial Court within three weeks from today and furnishing third party security for the balance 50%. It was further agreed that the petitioner shall continue to pay maintenance @ Rs.10,000/- per month from January, 2015 to the 1st respondent on or before 10th of every month. On deposit of the arrears of maintenance and the monthly maintenance, the 1st respondent is at liberty to withdraw the same. Accepting the concessions made by both parties, the Criminal Revision Case is disposed of in the above terms. The trial Court is advised to dispose of D.V.C.No.75 of 2012 within a period of three months from the date of receipt of a copy of this order and the petitioner and the 1st respondent shall cooperate for an early disposal of the D.V.C.
Consequently, miscellaneous petitions, if any, pending in the criminal revision case shall stand closed.
