THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3970 OF 2016 ORDER:

The petitioner claims that he is in possession and enjoyment of the lands admeasuring Ac.0-20 cents in Sy.No.966/F and Ac.0-37 cents in Sy.No.966/G situated at Kopparam Village, Santhamagulur Mandal, Prakasam District, and respondents 3 and 4 are trying to dispossess him from the said lands without following the due process of law.

Learned Government Pleader for Revenue has received instructions and states as follows:- "S.No.966/G admeasuring Ac.0.37 cents, 966/F admeasuring Ac.0-20 cents and 966/C admeasuring Ac.1-50 cents are classified as A.W land in the R.S.R. of Kopparam Village. These extents were assigned in favour of Smt.Chundi Lakshmi, W/o.John vide Dk.No.17/1417F dated 21-06-2008 by the then Tahsildar, Santhamagulur Mandal of Prakasam District for the purpose of agricultural use. No efforts are made to resume the land for the purpose of allotment to ICDS Buildings or Anganwadi Centers as claimed by the Writ Petitioner Chundi John, husband of deceased DK Pattadar Chundi Lakshmi."

In view of the above, it is clear that the petitioner has approached this Court merely on apprehension, which has no basis. However, if respondents 3 and 4 intend to take any action in respect of the lands of the petitioner, they would follow the due process of law. Accordingly, the writ petition is disposed of. No costs.
