ORDER
This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/accused Nos.1 and 2 seeking enlargement on bail in connection with Crime No.118 of 2026
of Nizamabad-I Town Police Station, Nizamabad District. The offences alleged against the petitioners are under Sections 109(1) r/w 3(5) of the BNS.

The case of the prosecution is that on 22.03.2026 at 08:00 hours the complainant lodged a complaint before the Police stating that on the intervening night of 21/22.03.2026 at about 01:00 hours he received a phone call from mobile No.62813 79493, wherein the caller asked him to come near Ek Minar Masjid. Believing the caller, the complainant went to the said place where he found about five to six persons present. One person introduced himself as Shaik Shoaib and stated that he had a video of a girl from their locality. Suddenly, all the accused persons assaulted the complainant with their hands. One among them was armed with a big knife and threatened to kill him. The said person attempted to attack the complainant with the knife but the complainant managed to escape. Meanwhile, on noticing the arrival of a police patrolling vehicle, all the accused persons fled from the scene. Hence, the complainant was registered against the accused persons and requested to take necessary action.
Based on the said complaint, the police registered a case for the aforesaid offences 3.
Heard Sri Alluri Divakar Reddy, learned counsel for the petitioners and Sri M.
Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and are in no way connected with the alleged incident. He further submitted that the petitioners have been in judicial custody since 23.03.2026 and that even according to the de-facto complainant no such injuries were sustained and there is no medical certificate to substantiate the allegations of the de-facto complainant. Therefore, he prayed that the Court grant bail to the petitioners by allowing this Criminal Petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that allegation against the petitioners are
grievous in nature and investigation was not yet completed and prayed to dismiss this petition.

Having regard to the submissions made by both the learned counsel and the material on record, the petitioners are in jail from 23.03.2026 and as seen from the record, LWs 1 to were already examined during the investigation.
Considering the facts and circumstances of the case and the period of incarceration of petitioners in jail, this Court deems it fit to grant bail to the petitioners subject to the following conditions:
i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned I Additional Judicial Magistrate of First Class at Nizamabad.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight
(8) weeks or till filing of charge sheet, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
