THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8663 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the Respondents in not providing suitable alternative employment as Record tracer/ out of designation (0.D) etc.. is illegal, arbitrary and contrary to the A.P.S.R.T.C. Service Regulations, circulars and the provisions of Act, 1 of 1996 the persons with DisabiLies (Equal, Opportunities, Protection of Rights and Full Partition )Act, 1995 and as well violation of Fundamental Rights guaranteed under the constitution of India and consequently direct the respondents to provide suitable alternate employment as Record tracer/ out of designation (0.D) etc.. as per Section 47 of the Act 1/1999."

Heard Sri A. Jagan, learned counsel for the petitioner and Sri A. Ravi Babu, learned Standing Counsel for respondents. When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2901-2016 to the Regional Manager, T.S.R.T.C., Karimnagar - 2nd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 2nd respondent to pass appropriate orders on the representation, dated 29-01-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and

submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent to consider and pass appropriate orders on the representation, dated 29-01-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of four

(4) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
