THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37117 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents in not giving protection to do cultivation in R.S.No.16/1G, to an extent of Ac. 3.50 cents in P.Rajavaram Village, Jeelugumilli Mandal, West Godavari District, as illegal and arbitrary and direct the 5th respondent to register the complaint, dated 29.03.2016, and take action against the persons against whom the petitioner has given a complaint.

Heard and perused the material available on record. The grievance of the petitioner is that the petitioner is the absolute owner and possessor of the subject land and that on 29.03.2016, some persons high-handedly came to the petitioner's land and threatening the petitioner, who was doing cultivation by engaging labour and immediately, the petitioner lodged a complaint against the said persons on 29.03.2016 to the 5th respondent, but the 5th respondent has not registered the same and not taken any action against the said persons. Considering the grievance of the petitioner, the 5th respondent is directed to register a case against the said persons in the complaint, if the complaint lodged by the petitioner, dated 29.03.2016, discloses any cognizable offence and investigate into the same and file a final report, if any. If the petitioner is aggrieved by the action of the 5th respondent, he is at liberty to approach the superior officer of the 5th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, in the writ petition shall stand closed.
