HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15648 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " .....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the respondents in considering the representation dt.31.10.2018 submitted by the petitioner seeking conversion of his post from Farrash to Junior Assistant in the existing vacancy basing on his educational qualification inspite of the personal visits as being illegal arbitrary and unjust and consequently direct the respondents to appoint the petitioner as Junior Assistant in the existing vacancy and to grant such other relief or reliefs ......" Heard Mr.K.Satyanarayana, the learned counsel for petitioner and the learned Government Pleader for Services-III.

It has been contended by the petitioner that he was appointed as Farrash on compassionate grounds on 22.05.2017 and since then, he has been discharging his duties to the satisfaction of every one concerned. While the petitioner was discharging his duties as Farrash, one vacancy in the cadre of Junior Assistant has arisen and the petitioner has submitted a representation to the respondents on 31.10.2018 to consider his case for conversion from Farrash to the post of Junior Assistant in view of his educational qualification. But, so far, the respondents have not passed any orders on the said representation nor considered the case of the petitioner for conversion from Farrash to the post of Junior Assistant.

Learned counsel for the petitioner has contended that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 31.10.2018 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
