THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15619 OF 2019 O R D E R :

The only grievance of the petitioner is that he applied III phase new electricity connection for his site admeasuring 200 sq.yards in Sy.No.424 of Ummarkhanguda Village, Abdullapurmet Mandal, Rangareddy District, by paying requisite fee and enclosing necessary documents before the respondents, but, till date no action has been taken by the respondents.

Learned counsel for the petitioner submits that as per Section 43(2) of the Electricity Act, 2003, it is the duty of every distribution licensee to provide electric line within 30 days from the date of filing of application; and that in default, as per Section 43(3) of the Act, the respondents are liable to pay Rs.1,000/- per day as penalty for the delay.

Heard Sri R.Vinod Reddy, learned Standing Counsel for respondents.

Since the application submitted by the petitioner is pending before the competent authority and the petitioner states that he has fulfilled all the requirements for grant of electricity connection, it is for the competent authority to consider and dispose of the same. In view of the same, the writ petition is disposed of directing the competent authority to consider the application of the petitioner in

accordance with Rule 43(1) of the Electricity Act, 2003 and take necessary action within one week from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
