HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3467 of 2014 ORDER:
When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner is a principal borrower and owing to various reasons, he could not repay the loan amount to the 3rd respondent Bank and the Bank had initiated proceedings and passed orders for recovering the said amount. Challenging the same, the petitioner has filed C.T.A.No.7 of 2014 before the A.P.Co-operative Tribunal, Hyderabad and the Tribunal has declined to grant interim order. Challenging the same, the present writ petition is filed.
This Court vide order dated 07.02.2014 was pleased to stay the confirmation of auction on condition of the petitioner depositing 50% of the demanded amount within two weeks. It is needless to state that the petitioner has filed C.T.A.No.7 of 2014 before the Tribunal. Therefore, it is always open for the petitioner to pursue his remedies before the Tribunal, if the petitioner has complied with the above interim order.
Hence, the writ petition is closed. It is always open for the petitioner to pursue his remedies in C.T.A.No.7 of 2014 before the Tribunal. No order as to costs.
