HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28171 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the show cause notice issued by the third respondent dated 07.07.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development(Andhra Pradesh) representing the respondents 1 to 5 and Sri Ravi Cheemalapati, learned standing counsel for Panchayat Raj (Andhra Pradesh) representing the sixth respondent.

3. A perusal of the record reveals that the petitioner was elected as a sarpanch of Garugubilli village Gram Panchayat of Vizianagaram District. On 07.07.2016 the third respondent issued a show cause notice in Rc.No.1782/2016/A1 to the petitioner calling for his explanation by suspending his cheque power. The petitioner submitted his explanation on 25.07.2016. For one reason or the other, the third respondent has not disposed of the representation of the petitioner.

4. The grievance of the petitioner is that the third respondent has no right whatsoever to suspend the cheque power of the petitioner indefinitely. Learned counsel for the petitioner submitted that the third respondent may be directed to dispose of the representation of the petitioner as expeditiously as possible. Learned Assistant Government Pleader also consented for the same.

5. Having regard to the facts and circumstances of the case and also the in view of the submissions made by both the counsel, the third respondent is hereby directed to dispose of the representation of the petitioner dated 25.07.2016 in the light of G.O.Ms.No.30 of Panchayat Raj and Rural Development and Relief dated 20.01.1995, as expeditiously as possible, preferably within a period of two weeks from the date of receipt of copy of this order.

6. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
