HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.8719 OF 2017 ORDER:
This Criminal Petition under Section 482 of Cr.P.C. is filed by the petitioner-accused No.1 seeking to quash the proceedings in Crime No.96 of 2016 pending on the file of Kavali I Town Police Station, SPSR Nellore District, registered for the offences under Section 498-A I.P.C and Sections 3 and 4 of the Dowry Prohibition Act, 1961 Heard the learned counsel for the petitioner/accused No.1, the learned Public Prosecutor appearing for the 1st respondent-State and perused the record.
Learned counsel for the petitioner/accused No.1 submits that the de-facto complainant (R-2) has deserted him in the year 2014; even in spite of mediation and efforts, she did not join the company of the petitioner/accused No.1 and she lodged report to the police on false allegations.
Learned Public Prosecutor would contend that there are specific allegations of dowry harassment against the petitioner/accused No.1 and there are no grounds to quash the proceedings in Crime No.96 of 2016. The material on record reveals that the petitioner/accused No.1 is the husband of the de-facto complainant, 2nd respondent herein. There is record to show that there are allegations of dowry harassment during the years 2014 to 2016. It is for the appropriate trial Court to decide the genuineness of the allegations against the petitioner/accused No.1. The petition is devoid of merits and there are no grounds to quash the proceedings in Crime No.96 of 2016, pending on the file of Kavali I Town Police Station, SPSR Nellore District.
Accordingly, the Criminal Petition is dismissed. As a sequel, pending miscellaneous petitions, if any, shall also stand dismissed.
