HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46721 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.87 of 2016 on the file of the 3rd respondent. 2.

Heard and perused the material available on record. 3.

It is stated that the above crime was registered for the offence punishable under Sections 498-A and 309 IPC on the basis of the complaint lodged by the brother of the wife of the petitioner. It is the case of the petitioner that the medical record including the dying declaration of his wife goes to show that his wife poured kerosene and burnt herself aggrieved over the action of the revenue officials in evicting his family, and that there is no material on record to implicate the petitioner. 4.

Considering the facts and circumstances of the case, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioner. The petitioner is directed to appear before the Station House Officer concerned daily at 9 a.m., for a period of fifteen (15) days and he is also directed to execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned, as surety for his future appearance as and when required for the purpose of investigation.
