HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4790 of 2018 ORDER:

This Criminal Petition is filed under Sections 437 and 439 Cr.P.C to enlarge the petitioner/Accused, who is in judicial custody since 16.11.2017, on bail in Crime No.F.No.DRI/HZU/48B/ENQ39(INT)/2017, registered for the offence punishable under Sections 25(A), 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Learned counsel for the petitioner contended that the petitioner filed petition under Section 167(2) Cr.P.C before theCourt below and the same is pending for adjudication and requested the Court to direct the Court below to dispose the said application in accordance with law immediately.

Learned counsel for the respondent did not oppose to issue a direction to the Court below concerned to dispose of the petition under Section 167(2) Cr.P.C. in accordance with law. In view of pendency of petition under Section 167(2) Cr.P.C., I deem it appropriate to direct I Additional District and Sessions Judge, Sanga Reddy to dispose of Crl.M.P.No.49 of 2018 in accordance with law, in any event not later than 10 days from today.

With the above observation, the criminal petition is disposed of without touching the merits of the case.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
