HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 16238 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a permanent Fair price Shop Dealer of Shop No. 24 of Komatikuntla village, Putlur Mandal, Ananthapur District. While the petitioner was continuing as such, the fourth respondent issued suspensioncum-show cause notice on 5.5.2015 by framing five charges against the petitioner. It appears that based on the panchanama conducted by the fifth respondent on 29.4.2015 in respect of the variation in stock, 6-A proceedings are pending consideration. However, the fourth respondent initiated separate proceedings for violation of APSPDS Control Order, 2008 and issued suspension-cum-show cause notice dated 5.5.2015. The petitioner through his Advocate filed objections to the said show cause notice.

The fourth respondent while prima facie coming to the conclusion that the petitioner contravened the provisions of APSPDS (Control) Order, 2008, suspended the dealership of the petitioner pending enquiry and gave further time to the petitioner to submit his explanation to the charges framed against him. A perusal of the charges framed against the petitioner do not warrant interference of this Court at this stage. However, as it is submitted by the learned Counsel for the petitioner that the petitioner has already submitted his explanation on 14.5.20015, the fourth respondent is directed to complete the enquiry and thereafter pass final order by duly observing the principles of natural justice, within a period of thirty days from the date of receipt of a copy of this order.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
