This writ petition is filed seeking declaration that the Notification SO No.168(E), published in Gazette of India No.149, dated 19.01.2016 and Award vide Rc.No.G1/2581/2014/NH-565, dated 27.06.2016 passed in the name of dead person i.e., late Mekala Venkateswarlu S/o Ramaiah by the 7th respondent and consequential action of respondents in insisting the petitioners to vacate from their agricultural land situated in Thokapalli Village, Peddaraveedu Mandal, Prakasam District, which is alleged to have acquired for the purpose of up-gradation and improvement of NH-565, as illegal.

2. Learned standing counsel for the 7th respondent submits that a fresh award shall be passed after hearing the petitioners as per law. In view of the statement made by the learned standing counsel for the 7th respondent, learned counsel appearing on behalf of the petitioners, prays this court to close the writ petition by setting aside the orders impugned in this writ petition.

3. Accordingly, the writ petition is closed. Consequently, the Notification S.O. No.168(E), published in Gazette of India No.149, dated 19.01.2016 and Award vide Rc.No.G1/2581/2014/NH-565, dated 27.06.2016 passed in the name of dead person i.e., late Mekala Venkateswarlu S/o Ramaiah, by the 7th respondent, is hereby quashed. Pursuant to the aforesaid award, no steps shall be taken against the land of the petitioners. No order as to costs.
