HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26042 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondents 2 and 3 in disposing of the representations of the petitioner dated 09.03.2016 and 19.05.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development for the State of Telangana and Sri G.Narender Reddy, learned standing counsel appearing for the third respondent.

3. The petitioner is a resident of Ibrahimpatnam Village and Mandal of Karimnagar District. The fourth respondent is the neighbour of the petitioner. The case of the petitioner is that the fourth respondent is making construction without obtaining necessary permission from the third respondent and in gross violation of the provisions of the Andhra Pradesh Panchayat Raj Act, 1994 and the Andhra Pradesh Gram Panchayat Land Development (Lay out and building) Rules, 2002. The further case of the petitioner is that he submitted representations dated 19.05.2016 and 09.03.2016 to the second and third respondents respectively requesting them to take appropriate action against the fourth respondent. The grievance of the petitioner is that respondents 2 and 3 have not taken any action in pursuance of his representations. Both counsels in one voice submitted that the respondents 2 and 3 may be directed to dispose of the representations submitted by the petitioner.

4. In view of the submissions made by both counsel, this

Court is not inclined to go into the merits of the main case.

5. Having regard to the facts and circumstances of the case, respondents 2 and 3 are hereby directed to dispose of the representations of the petitioner dated 19.05.2016 and 09.03.2016 in the light of the provisions of the Andhra Pradesh Panchayat Raj Act, 1994 and the Andhra Pradesh Gram Panchayat Land Development (Layout and Building) Rules, 2002, as expeditiously as possible, preferably, within a period of one month from the date of receipt of copy of this order.

6. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
