HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.8677 of 2017

ORDER

This writ petition is filed seeking to declare the action of the respondents in calling the petitioner to the police station and harassing him, as arbitrary and illegal.

Learned Government Pleader for Home, on written instructions, submits that on receipt of the complaint, an entry was made in the Station General Diary on 6.3.2017 at 19.30 hours. The contents of the complaint appeared to be noncognizable in nature. Accordingly, a requisition was filed before the IV Special Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, to accord permission to investigate into the non-cognizable complaint and permission is awaited. He further submits that during the enquiry, it came to light that the person, who caused blows to the complainant, is one of the petitioners herein. In order to prevent the police from taking any action, the present writ petition is filed. In the written instructions, the other allegations of harassment are denied in the following terms.

" It is submitted that the allegation of the petitioner that on 8.3.2017, after multiple calls from this

respondent asking his grandfather to bring him to the police station for inquiry, he was taken his grandfather to Bachupally Police Station, Cyberabad at 3.15 p.

and make a confession against Vineet as they direct him to do so are false, baseless, concocted, exaggerated and invented for the purpose of filing the present writ petition and more they made to gain sympathy from this Hon'ble Court.

It is pertinent to submit that on entering the above complaint into the Station General Diary, this respondent police has verified the unknown persons who caused blows on the complainant and it came to light that the petitioner and his friends involved in the incident of fisting of blows on the complainant face. Upon which, this respondent police tried for the petitioner over phone. Instead of approaching this respondent police station and informed the real facts, the petitioner rushed to this Hon'ble Court and filed the writ petition with false, baseless and exaggerated allegations."

In view of the same, no further orders can be passed in the present writ petition except directing the respondent-police to complete the investigation, in accordance with law.
