THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.4051 of 2022 ORDER:

This Criminal Petition under Section 438 Criminal Procedure Code is filed by petitioners, who are arrayed as accused No.1 and 2, seeking bail in the event of their arrest in connection with Crime No.88 of 2022 on the file of Thorrur Police Station, registered for the offences under Sections 447 and 307 read with Section 34 of Indian Penal Code.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondentState and perused the record.

3. The petitioners alleged to have indulged in fight with the de facto complainant and others on 09.04.2022 for the reason of there being dispute regarding a piece of land. The petitioners and the

de facto complainant are relatives. The 1st petitioner received grievous injury resulting fracture to the left shoulder as informed by the petitioner and as seen from the medical report filed along with the bail application. It is a case and counter case, for which reason custodial interrogation is not required. In the back ground of free fight between the two groups, the petitioners can be granted relief of anticipatory bail.

This criminal petition is, accordingly, allowed and the petitioners 1 and 2/accused No.1 and 2 are granted anticipatory bail subject to the following conditions:

(1) The petitioners 1 and 2/Accused No.1 and 2 are directed to surrender before the Station House Officer, Thorrur police Station, within ten days from the date of this order, and, on such surrender, the petitioners are directed to be released on bail on their furnishing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) each with two sureties to the like sum each to his satisfaction.

(2) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.

(3) The petitioners are directed to appear before the concerned police on every Sunday between 10 a.m and 1 p.m. for a period of eight weeks. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
