THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.31731 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the respondents-police to register a case basing on the complaint of the petitioner dated 03.09.2016 against the culprits alleged therein.

The main grievance of the petitioner is that the Station House Officer, Narsimhulupeta Police Station, Warangal District-3rd respondent herein is not registering a case against the culprits alleged by the petitioner in his complaint dated 03.09.2016. Learned Additional Government Pleader, on instructions, informed that the 3rd respondent has not received any complaint from the petitioner.

Considering the facts and circumstances of the case, without going into the merits in the allegations made in the writ petition, the petitioner is directed to lodge a fresh complaint before the 3rd respondent on or before 30th October, 2016 and on such complaint, the 3rd respondent is directed to register a case if it discloses any cognizable offence and investigate into the same and file a final report if any in accordance with law.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 18.10.2016.
