THE HONOURABLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION NO.5615 OF 2023 ORDER :

This petition is filed under Section 438 of Criminal Procedure Code, 1973 (Cr.P.C) seeking anticipatory bail to the petitioners, who are accused Nos.1 to 3 in Crime No.60 of 2023 of Nirmal Rural Police Station, Nirmal District. The offence alleged against the petitioners is under Section 306 read with Section 511 of the Indian Penal Code. 2.

The sum and substance of case of the prosecution is that the victim and accused No.1 are wife and husband. On 01.05.2023 the victim allegedly consumed pesticide and made a text to his sister expressing his attempt to commit suicide. Immediately his family members responded and he was shifted to Government Hospital at Nirmal and he was saved. On verification of reason for such attempt, the accused allegedly stated that on account of harassment of his wife and in laws, he made such attempt.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent - State. 4.

The complaint is lack of details of harassment and the dates of such harassments were made. Admittedly, at the time of alleged incident, the present petitioners are not with the victim. There is no material as of now that the alleged act of the victim was a result of any impact on account of torture made by the present petitioners. In the said circumstances, it is a fit case to grant bail to the petitioners - accused Nos.1 to 3.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners-accused Nos.1 to 3 are enlarged on bail in the event of their arrest in connection with FIR No.60 of 2023 on the file of the Station House Officer, Nirmal Rural Police Station, Nirmal District on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties to the like sum each to the satisfaction of concerned Station House Officer.

(ii) The petitioners-accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
