THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 810 OF 2015 O R D E R:
The petitioner sought for a writ of mandamus for declaring the action of the 2nd respondent in issuing the Memo dated 30.12.2014, trying to remove her from service as Village Coordinator (Saakshar Bharath) at Krishna Mahantipuram Village, H/o Kiltampalem Gram Panchayat, Srungavarapukota Mandal, Vizainagaram District, without conducting any enquiry, as illegal.
I am afraid this Writ Petition is a misconceived one. A show cause notice was issued to the petitioner on 30.12.2014 calling for an explanation as to why her services cannot be dispensed with for the allegations set out therein. It appears, the petitioner has submitted her explanation on 02.01.2015. No orders have been passed removing her from service. On a mere apprehension that her services are likely to be terminated, the present Writ Petition is filed. A writ of mandamus, in such circumstances, cannot be issued as prayed for. Hence, this Writ Petition is dismissed at the admission stage, after hearing Sri Cheemalapati Ravi, learned Standing Counsel for the 2nd respondent. No costs.
Consequently, the miscellaneous applications, if any shall also stand dismissed.
