THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.34172 of 2015 ORDER :

Petitioner is a resident of Chodimella Village, Eluru, West Godavari District. Petitioner contends that the 7th respondent is installing Telecommunication Infrastructure tower, without obtaining proper permission.

2. According to learned counsel for the petitioner, Gram panchayat has

passed a resolution on 22.10.2013 opposing construction and establishment of ground based Telecommunication Infrastructure Tower (TIT) in the village. Therefore, no TIT can be installed in the village.

3. Learned counsel representing 7th respondent submits that so far no such tower is being installed and only on 15.09.2015, application is submitted to the Gram Panchayat and the said application is pending consideration of the Gram Panchayat.

4. Having regard to the said statement made by the learned counsel for the 7th respondent, this writ petition is disposed of, leaving it open to the petitioner to file objections opposing installation of TIT, in pursuant to the application submitted by the 7th respondent on 15.09.2015. If any objections are filed by the petitioner, the Gram panchayat shall consider the same, before granting permission to the 7th respondent. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J 14th October, 2015.
