The case of the petitioner is that he was removed from the post of Field Assistant based on the criminal case i.e. S.C.No.189 of 2017 without considering the acquittal of the petitioner in the said criminal case on 24-07-2017. Thereafter, the petitioner filed appeal before the 2nd respondent. As the said appeal is not being disposed of, the present writ petition is filed.
Heard learned counsel for the petitioner.
Sri M.S.R.Chandramurthy, learned Standing Counsel for respondents 2 and 5 submits that the 2nd respondent is not the appellate authority, it is the 3rd respondent who is the appellate authority.
In view of the same, it is open for the petitioner to file appeal to the 3rd respondent narrating the above facts and the 3rd respondent is directed to consider the said aspect and pass orders within a period of two months from the date of receipt of filing the appeal.
With the above observations, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 18-04-2018 Nvl
