THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30049 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of Shop No.8, Chennuru Village and Mandal in Y.S.R.Kadapa District. On the basis of the report submitted by the Enforcement Deputy Tahsildar, dated 17.02.2015, a show cause notice was issued to the petitioner on 23.03.2015. The petitioner submitted her explanation on 31.03.2015. After receipt of the explanation, the authorization of the petitioner was suspended by the third respondent on 23.04.2015. Challenging the same, the present Writ Petition is filed.

Four charges are alleged against the petitioner and a perusal of the said charges shows that they require further enquiry.

In the circumstances, this Court is not inclined to interfere with the enquiry process at this stage and as the petitioner had already submitted her explanation, the third respondent is directed to conduct the enquiry in respect of the charges by giving due opportunity to the petitioner and pass final orders thereon, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed.
