M/S. Chetak Carriers, Hyderabad. v. Labour Court-I, Hyderabad And Another
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23779 OF 2004 ORDER:
This writ petition is filed seeking a Writ of Certiorari to quash the order, dated 08.10.2004, passed in M.P. No.20 of 2001 by respondent No.1 - Labour Court-I, Hyderabad.
2. Heard Sri Vedula Srinivas, learned counsel for the petitioner and learned Government Pleader appearing for respondent No.1.
3. The learned counsel for the petitioner would contend that respondent No.1 without appreciating any of the contentions raised by the petitioner, allowed the M.P. in part mechanically, directing that an amount of Rs.26,629/- be paid to respondent No.2 - Workman. He also contends that this Court was pleased to grant interim stay of the said order passed by respondent No.1, by order, dated 21.12.2004, in W.P.M.P. No.31186 of 2004, subject to deposit of Rs.13,000/- by the petitioner herein; and that the only issue remains is that the balance amount of Rs.13,629/- to be paid to respondent No.2 - Workman.
4. Having considered the above submission made by the learned counsel for the petitioner, this Court is of the considered view that unless and until there are grave irregularities or illegalities pointed out by the learned counsel for the petitioner, it becomes difficult for this Court to interfere with the order under challenge. Since no irregularity or illegality is pointed out, this Court is not
inclined to interfere with the order under challenge. The present writ petition is devoid of merits and the same is liable to be dismissed.
5. Accordingly, the present Writ Petition is dismissed. However, in the circumstances of the case, there shall be no order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the present writ petition stand closed.
