HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35809 OF 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India is preferred by the petitioners seeking to declare the inaction of the respondents in taking action on petitioners' representation dated 01.09.2016 and not safeguarding the Wakf lands admeasuring Acs.9-10 cents in survey No.541 and Ac.0.22 cents in survey No.173/7 situated at Tharlapadu Village and Mandal, Prakasam District and not canceling the pattadar passbook and title deeds issued in favour of R.7 as arbitrary and illegal. Heard the learned counsel for the petitioner, the learned Asst. Government Pleader for Revenue (AP) for respondents 1 to 4 and Sri Arifullah, learned Standing Counsel for A.P. State Wakf Board, for respondents 5 and 6. With their consent, the Writ Petition is disposed of at the stage of admission itself. There is no necessity to put respondent No.7 on notice as this Court is not venturing to adjudicate the issue on merits.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to respondents to consider the representation of the petitioners dated 01.09.2016.

Learned AGP submits that since the representation was made in the month of September, 2016, necessary direction may be given to R.2 to dispose of the representation, if not already disposed of.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-The District Collector, Prakasam District, to consider the representation of the petitioners dated 01.09.2016 and dispose of the same, if not already disposed of, after hearing the petitioners and aggrieved persons, if any, including the 7th respondent herein, in accordance with law as early as possible preferably within a period of eight weeks from the date of receipt of a copy of this order.
