THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No.38660 OF 2014 ORDER:

None appears for the petitioner when the matter is taken up today. On 16.12.2014, 23.12.2014 and 19.01.2015 requests were made on behalf of the petitioner seeking adjournment.

The petitioner herein calls in question the notice published on 07.08.2014 informing that the writ petitioner, upon completion of '58' years, would be retiring from service in the month of December, 2014.

The petitioner holds the post of Lecturer in Urdu in Oriental Urdu College, Himayathnagar. Even assuming that the said institution as well as the post held therein by the petitioner are admitted to grant-in-aid by the State Government, but nonetheless the petitioner cannot seek parity of treatment with that of the Government servants of State of Andhra Pradesh in the matter of age of superannuation. It is to be noted that the age of superannuation for the government servants of the State of Andhra Pradesh has been enhanced from 58 to 60 years, which is notified through G.O.Ms.No. 147, Finance Department, dated 30.06.2014. The said notification will not be attracted to in its sweep and application to the case of the petitioner unless a similar term of employment is incorporated in the conditions of service, by which he is regulated. I, therefore, do not find any merit in this writ petition and it is accordingly dismissed. But however, without costs.

All the miscellaneous petitions pending in this writ petition shall stand closed.
