Heard the learned counsel for the petitioners, learned Government Pleader for Social Welfare appearing for respondent Nos.1 to 3, and learned counsel for respondent No.4.
This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of 1st respondent in not receiving the appeal filed by the 2nd petitioner under Section 3(3) of Regulation No.1 of 1959 read with Order 41 Rule 1 read with Section 151 of CPC against the orders passed by 2nd respondent in Case No.233/2010/MKP dated 18.02.2011 as illegal and arbitrary.
Learned Government Pleader for Social Welfare, on written instructions received from the 3rd respondent dated 27.02.2016, states that in compliance with the orders of the 2nd respondent, the concerned Village Revenue Officer, the Mandal Revenue Inspector and the Mandal Surveyor proceeded to the land, conducted panchnama and handed over the land to the 4th respondent. He further states that the 1st petitioner, who is father of 2nd petitioner, has not filed any appeal or obtained any stay orders from the appellate authority within the stipulated time i.e., 60 days from the date of order of the 2nd respondent. In view of the submission of the learned Government Pleader, this Court finds no merit in the writ petition, and
accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Consequently, miscellaneous petitions if any pending in the writ petition shall also stand dismissed. _____________________________ A. RAJASHEKER REDDY, J.
