HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15691 of 2019 ORDER:
This writ petition is disposed of at the stage of admission with the consent of both the parties.
This writ petition is filed seeking the following relief :- " .....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the respondents in finalizing the selection and appointment of the candidates for the post of Shramik in response to the Notification dt.2.11.2010 and in compliance of the orders passed in W.P.No.11188 of 2011 inspite of the written representations dt.14.8.2015, 17.6.2017 and 19.1.2019 as being illegal, arbitrary and unjust and consequently direct the respondent authorities to finalize the selection and appointment of the candidates for the post of Shramik in response to the notification dt.2.11.2010......" .
Heard Mr.G.Rajesh, the learned counsel for petitioners and Sri A.Ravi Babu, the learned Standing Counsel for respondents. It has been contended by the petitioners that they are fully eligible and qualified to be appointed to the post of Shramik and the respondents have issued recruitment Notification on 02.11.2010. The petitioners have responded to the said Notification and participated in the selection process and they were provisionally selected. However, the respondents, for the reasons best known to them, have cancelled the said recruitment. Aggrieved thereby, the petitioners along with others filed W.P.No.11188 of 2011 and this
Court disposed of the said writ petition on 19.09.2011 by observing as follows :-.
a).
directing that the respondents shall make selection and appointment of candidates from out of the applicants, that have submitted their applications, in response to the notification dated 02.11.2010, but it shall be open to them to apply the norms, that have decided in accordance with law. b).
it shall also be open to the respondents to finalise the list of selected candidates, as per the existing norms; and c).
the notification dated 12.05.2011 shall stand cancelled. Aggrieved by the said order, the petitioners and others filed W.A.No.1253 of 2011 and the Division Bench of this Court was pleased to dismiss the writ appeal on 20.09.2013 confirming the order passed by this Court in W.P.No.11188 of 2011 dated 19.09.2011. The petitioners submit that in spite of the directions of this Court in W.P.No.11188 of 2011 dated 19.09.2011, the respondents have not finalized the selection process. Therefore, the petitioners have filed representations on 14.08.2015, 17.06.2017 and 19.01.2019, but, so far, the respondents have not passed any orders on the said representations nor considered the case of petitioners for appointment to the post of Shramik.
Learned counsel for the petitioners submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioners and pass appropriate orders in accordance with law.
Learned Standing Counsel appearing for the respondents has contended that the case of the petitioners will be considered and
appropriate orders would be passed on the representations submitted by the petitioners in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioners on 14.08.2015, 17.06.2017 and 19.01.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
