HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.13469 of 2018 ORDER::

The case of the petitioner is that he joined the respondent-Andhra Bank as Clerk on 23-01-1998 and was eventually promoted as Officer Scale-I and Scale-II. On certain charges he was placed under suspension by order dated 1512-2015 and a charge sheet was issued to him, to which the petitioner is stated to have filed his explanation denying the allegations levelled therein. It is stated that enquiry was conducted and the enquiry officer submitted his report to the disciplinary authority, which in turn imposed a punishment of compulsory retirement from the service of respondent-Bank. Hence, this writ petition is filed against the impugned order dated 14-09-2017 requiring the petitioner to retire compulsorily from the service of the Bank.

Heard the learned counsel for the petitioner. None appears for the respondents.

Since it is stated that the petitioner has already availed the alternative remedy of filing statutory appeal before the 2nd respondent against impugned order and the

same is pending. Therefore, without expressing any opinion on the merits of the matter, the writ petition is disposed of directing the 2nd respondent to dispose of the statutory appeal filed by the petitioner, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
