HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15668 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

When the matter is taken up for hearing, both the counsel submit that the issue raised in this writ petition is squarely covered by the order of this Court in W.P.No.26528 of 2018 dated 31.07.2018. Learned counsel for the petitioner submits that the respondents are not reviewing the suspension order of the petitioner in terms of G.O.Ms.No.86 dated 08.03.1994.

Learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed by reviewing the suspension order of the petitioner in terms of G.O.Ms.No.86 dated 08.03.1994.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension order of the petitioner in terms of G.O.Ms.No.86 dated 08.03.1994 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

If the subsistence allowance is not paid to the petitioner, the respondents are directed to pay the subsistence allowance to the

petitioner within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. ____________________________ ABHINAND KUMAR SHAVILI, J Date: 25-07-2019 Prv
