THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.876 OF 2005 ORDER:
Today, when the matter is called at 02:30 PM, there is no representation for the revision petitioner.
2. Learned counsel for respondent Nos.1 to 3 - accused Nos.1 to 3 is present and would submit that against the very same judgment, which is under challenge in this revision case, respondent Nos.1 to 3 have preferred Criminal Appeal No.5 of 2004 and the same was allowed on 30.01.2009 and sought time to produce certified copy of the said judgment.
3. At his request, the matter was initially directed to be listed on 23.11.2017, but, at 04:00 PM, learned counsel for the revision petitioner appeared and would report that the appeal preferred by respondent Nos.1 to 3 was allowed and, therefore, the present revision case rendered infructuous and requests to dismiss the revision case as infructuous.
4. Having regard to the submission made by the learned counsel for revision petitioner, the present revision case is dismissed as infructuous.
5. Miscellaneous Petitions, if any, pending in this revision case shall stand closed.
