HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9095 of 2017 ORDER:
Heard learned counsel for the petitioner, learned Public Prosecutor and perused the record.
This Criminal Petition is filed to quash the proceedings in F.I.R.No.143 of 2017 on the file of Kamalapur Police Station, Warangal District.
Learned counsel for the petitioner would submit that the afore-mentioned Crime was registered against the petitioner for the offence under Section-3 (1)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015. He would further submit that even the message circulated in Whatsapp does not reveal any insult as envisaged under the above provision of law and hence, there is nothing to investigate in this case and prayed to quash the said proceedings against the petitoner.
It is brought to the notice of this Court that the matter is under investigation.
Under these circumstances, the arrest of the petitioner in respect of F.I.R.No.143 of 2017 on the file of Kamalapur Police Station, Warangal District is stayed and the Police concerned
shall proceed with investigation into the case in accordance with law.
With these directions, the Criminal Petition is disposed of. As a sequel, the Miscellaneous Petitions, if any, shall stand disposed of.
