Heard Mr. M.M. Srinivasa Rao for petitioners and the Assistant Government Pleader (Revenue).

Petitioners pray for Mandamus declaring the inaction of second respondent in disposing of ROR Appeal No.1 of 2016 filed by the fourth respondent on 28.01.2016 concerning Sy.Nos.17, 27, 43, 64, 77, 80, 86, 88, 89, 172, 179, 180, 183, 189, 1/ a and 1/ aa admeasuring Ac.22.55 cents at Damarachala village, Kukunuru Mandal, West Godavari, as illegal and amounts to refusing the exercise of jurisdiction conferred on the second respondent. 3.

The learned counsel for petitioners made a few submissions on merits of the appeal pending before the second respondent. This Court is neither considering nor examining the submissions of counsel for petitioners, for the substantive prayer against the act of omission or commission by third respondent is subjudice in Appeal No.1 of 2016. However, having regard to the urgency stated by petitioners and after hearing the Assistant Government Pleader, the writ petition is disposed of by this order.

The second respondent is directed to hear and dispose of ROR Appeal No.1 of 2016 in accordance with law, after issuing notice to the fourth respondent, within three (3) months from the date of receipt of a copy of this order. Petitioners are also given liberty to communicate

the order in this writ petition for expeditious consideration and disposal by second respondent. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J September 12, 2016 DSK
