HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12430 OF 2015 ORDER:
This writ petition is filed by the petitioner to declare the action of the respondents 7 and 8 in dispossessing the petitioner from his land an extent of Acs.50-10 cents in Survey No.42 of Kanthalacheruvu Village, Yadamari Mandal, Chittoor District, without issuing any notice, is as illegal and arbitrary and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner's land.
Though the writ petition was filed by the petitioner alleging the interference of the respondents 7 and 8 with the possession and enjoyment of the petitioner over the subject property, at the time of hearing learned counsel for the petitioner fairly submits that the petitioner has filed an appeal before the 3rd respondent-Revenue Divisional Officer against the order of the 2nd respondent-Tahasildar, Yadamari Mandal passed in Roc.A/361/2011, dated 24.11.2011, and hence the Revenue Divisional Officer may be directed to dispose of the appeal filed by the petitioner in a time bound manner. The request made by the learned counsel for the petitioner is not opposed by the learned Government Pleader for Revenue (AP).
Considering the submission of the learned counsel for the petitioner, there shall be a direction to the 3rd respondent-Revenue Divisional Officer to dispose of the appeal filed by the petitioner on merits within a period of three months from today.
With the above observations, the writ petition is disposed of at the admission stage. There shall be no order as to costs. Miscellaneous Petitions, pending if any in this writ petition, shall stand closed.
