THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4453 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.3 seeking to quash the proceedings against him in S.C.No.7 of 2017 on the file of Senior Civil Judge, Kothagudem.

Heard the learned counsel for the petitioner/Accused No.3 and the learned Additional Public Prosecutor representing the 1st respondent-State. Perused the record.

Though learned counsel for the petitioner filed the petition for quashing the proceedings in the aforesaid Sessions Case, he restricts his prayer seeking dispensation of personal appearance of the petitioner/Accused No.3 before the Court below in the aforesaid Sessions Case.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioner, without expressing any opinion on the merits of the case, the personal appearance of the petitioner/Accused No.3 in S.C.No.7 of 2017 on the file of Senior Civil Judge, Kothagudem, is dispensed with, while permitting the petitioner to make his appearance through his counsel. However, the petitioner/Accused No.3 shall appear before the Court below as and when his personal appearance is so warranted, in respect of the aforesaid Sessions Case. 5.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
