HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 4371 OF 2019 ORDER:
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') is filed by the petitioners - accused Nos.2 and 3 seeking to quash the proceedings against them in Calendar Case No.2120 of 2017 on the file of the learned XIV Additional Metropolitan Magistrate, Cyberabad at Rajendra Nagar (Old VII Metropolitan Magistrate).
2. Charge sheet came to be filed against the petitioners and another for the offences punishable under Section 498-A of the Indian Penal Code, 1860, and Sections 3 and 4 of Dowry Prohibition Act, 1961, in Crime No.69 of 2016 dated 23.02.2016 of R.G.I. Airport Police Station, Cyberabad.
3. Though the present criminal petition is filed seeking to quash the entire proceedings, learned counsel for the petitioners restricts the prayer seeking to dispense with the presence of the petitioners before the trial Court on every date of hearing.
4. Learned Public Prosecutor submits that since identity of the petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of hearing.
5. Having regard to the facts and circumstances of the case, personal appearance of the petitioners in Calendar Case No.2120 of 2017 on the file of the learned XIV Additional Metropolitan
Magistrate, Cyberabad at Rajendra Nagar (Old VII Metropolitan Magistrate), is hereby dispensed with, except on the dates when their presence is specifically required by the trial Court.
6. With the above directions, the Criminal Petition is disposed of.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
