THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3154 of 2015 ORDER:

1. This Criminal Revision Case is filed by the petitioner aggrieved by the order dated 26.10.2015 passed in Crl.M.P.No.924 of 2015 in Crime No.320 of 2015 by the II Additional Junior Civil Judge-cum-XXIII Metropolitan Magistrate, Cyberabad at Rajendranagar.

2. The petitioner-owner of the vehicle filed the above Crl.M.P. seeking to return his vehicle viz., Car bearing No.AP 28 DX 7218 seized in the above crime. The learned Magistrate dismissed the said application. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. From the material on record, it is apparent that the vehicle in question was involved in the above crime registered for the offence under Section 302 IPC. On that ground, the learned Magistrate refused to return the vehicle. This Court does not find any ground to interfere with the order under revision.

5. Accordingly, the Criminal Revision Case is dismissed. However, the petitioner is directed to file fresh application before the Court concerned for return of the vehicle in question, after committal of the case to the Court of Sessions.
