HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 11299 of 2012 ORDER:

With the consent of both the parties, this Writ Petition is being disposed of at the admission stage. The present Writ Petition came to be filed seeking issuance of a writ of mandamus directing the 3rd respondent/Tahasildar to take necessary action on the application of the Writ Petitioner seeking for issuance of Ryotwari patta and title deed in respect of the lands purchased by the petitioner under two registered sale deeds dated 03.03.2008 and 03.04.2008.

The facts of the case are as under :

The Writ Petitioner purchased Ac.4.72 cents of land in Sy.No.326/2 of Desapatrunipalem Revenue village of Parvada Mandal out of total extent of Ac.14.08 cents of the land situated in Sy.No.326/2. It is stated that the Writ Petitioner purchased the said land in two bits by two separate registered sale deeds. Thereafter he filed O.S.No.191 of 2007 on the file of Principal Senior Civil Judge, Anakapalle against one Kunisetty Padma for specific performance of an agreement of sale executed by her in favour of the petitioner agreeing to sell the writ lands. The said suit was decreed on 23.11.2007. After

obtaining decree, the said Padma is alleged to have executed two separate registered sale deeds dated 03.03.2008 and 03.04.2008 in favour of the writ petitioner conveying her rights.

Further the averments in the affidavit show that the petitioner is in possession of the said lands since then. On 18.02.2012 the petitioner is said to have given representation to the 3rd respondent requesting to issue Ryotwari Pass Books and Title deeds. Inaction of the respondent in granting the passbook and title deed is challenged in this writ petition. Though various grounds are raised in the Writ Petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 3rd respondent to dispose of the representation dated 18.02.2012 at the earliest.

The learned Government Pleader for the respondents submits that he has no objection for the same.

Having regard to the circumstances of the case, the Writ Petition is disposed of directing the 3rd respondent/Tahasildar to dispose of the representation of the Writ Petitioner dated 18.02.2012 in accordance with law, within 12 weeks from the date of receipt of this order, if the same is still pending. No order as to costs. Miscellaneous Petitions pending if any in this Writ Petition

shall stand closed.
