THE HON'BLE SRI JUSTICE PRAVEEN KUMAR WRIT PETITION No. 17759 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home.

With the consent of both the parties, the writ petition is disposed of at the admission stage.

Questioning the inaction of the respondents in taking action on the report dated 15.05.2016, made by the petitioner, the present writ petition is filed.

The grievance of the petitioner appears to be that he has been in possession of property situated in Survey No.191-D(old), 209/3(new), admeasuring Ac.0.20 cents, situated at Anantapuramu Town. While so, one Pamulapati Ramasubbaiah, Putluru Hanumentha Reddy, Jagdeeshwara Reddy, Eediga Pedaramanjaneyulu and Eediga Peddavenkatesulu tried to interfere with peaceful possession and enjoyment of the said property. Then he filed a suit in the year 2015 for injunction. On 29.12.2015, an exparte decree came to be passed in the said suit restraining the defendants from interfering with the peaceful possession and enjoyment of the plaint schedule property. Since the above said persons were interfering with the property inspite of there being order by the Civil Court, the petitioner lodged a report before the third respondent.

It is stated that though the report was lodged on 15.05.2016, till date not action is taken upon. The inaction of the respondents lead to filing of the present writ petition. Though various grounds are raised, learned counsel for the petitioner seeks a direction to the Superintendent of Police to take appropriate action pursuant to his report dated 15.05.2016.

Having regard to the facts and circumstances and without going into merits of the case, the third respondent with whom a report is said to have been lodged, shall take appropriate action, in accordance with law, as early as possible, if the same is still pending consideration.

Accordingly, the Writ Petition is disposed of. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs.
