THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10781 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the respondents 2 to 4 in not stopping and demolishing the illegal and unauthorized construction being made by the 5th respondent in House No.13-3-1091 (portion) existing on the eastern side of the petitioner's house bearing No.13-3-1091 (portion) situated at Qamaraqu Gumbad, Ziaguda, Hyderabad, as illegal and arbitrary and consequently, direct the respondents 2 to 4 to forthwith take action to stop and demolish the illegal and unauthorized construction made by the 5th respondent.

The case of the petitioner is that the he purchased the subject under registered sale deed No.353/ 2017. The 5th respondent is claiming to be the owner of the portion of the said house and has demolished his old house and started illegal and unauthorized construction with multi stories. The petitioner made complaints on 27.01.2017, 27.02.2017 and 17.03.2017 to the 4th respondent. Inspite of the said representations, no action has been taken by the authorities and the 5th respondent is proceeding with the construction, without there being any permission. Considering the nature of the grievance of the petitioner, the respondents 3 and 4 are directed to act upon the complaints of the petitioner and if the allegations made by the petitioner are true, necessary action shall be initiated against the 5th respondent. Subject to the above, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, W.P.M.Ps., if any pending, shall stand closed.
