HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.13432 of 2018 ORDER:
This writ petition is filed challenging the suspension order dated 22-01-2018, wherein and whereby the petitioner was suspended pending enquiry.
Learned counsel for the petitioner says that along with petitioner one R.Laxman TTI was also suspended under the same charge and this Court suspended the order of suspension of said employee. He submits that the petitioner is not responsible for the irregularities alleged against him and it is not such a serious case, where suspension pending enquiry is required. Though charge memo issued on 22-01-2018 and the petitioner submitted representations on 25-01-2018, 30-01-2018 and 05-03-2018 to the respondents to furnish relevant documents, but the same are not supplied to him. Learned counsel for the petitioner tried to say that charges made against the petitioner are false by referring to a report. But the learned Standing Counsel for the respondentCorporation submits that though the petitioner and R.Laxman, TTI colluded, the role of petitioner is different than the said Laxman, TTI and further submits that in the enquiry, truth or otherwise of the allegations will be gone into, since the enquiry officer is also appointed.
This Court will not, ordinarily, interfere with the order of suspension, unless it is without jurisdiction or arbitrary. The truth or otherwise of allegations can be looked into in the
enquiry. In this case enquiry officer is also appointed. Learned counsel says that the petitioner received relevant documents yesterday.
In view of the same, the respondents are directed to conclude the enquiry within a period four weeks from the date of receipt of a copy of this order, since the petitioner was suspended in January, 2018. If the enquiry is not concluded within the aforesaid period, the respondents are directed to reinstate the petitioner and the same will be subject to enquiry. Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
