THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4688 of 2015 ORDER:

This writ petition is filed seeking a mandamus declaring the action of the 2nd respondent in not receiving the application submitted by the petitioner for grant of building permission with regard to property admeasuring 119.65 square yards in premises bearing municipal No.1-3-176/97/B (New No.1-3-176/97/1/B) in plot No.28 situated at Kawadiguda, Hyderabad, as illegal and arbitrary. When the matter is taken up for hearing, the learned counsel for the petitioner submitted that in similar circumstances, this Court passed an order dated 07.06.2012 in W.P.No.16601 of 2012 and prayed that similar orders may be passed in this writ petition, and the same is not disputed by the learned counsel for the 2nd respondent.

The operative portion of the said order reads as under: "In view of the submission of the learned counsel, without going into the merits of the claim of the petitioners, I deem it appropriate to direct the respondents to receive the application of the petitioners for grant of building permission without insisting on no objection certificate from the revenue authorities/District Collector. However, it is open to the respondents to examine the title of the petitioners for grant of building permission based on the documents to be filed by them along with the application."

Following the order dated 07.06.2012 in W.P.No.16601 of 2012, this Writ Petition is disposed of, in the above terms. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of.
